OVERVIEW
Welcome to Metaloslav! The terms “we”, “us” and “our” refer to Metaloslav. We operate this website and store (the “Services”), powered by Shopify. These Terms of Service (“Terms”) together with the policies referenced here describe your rights and responsibilities when using the Services.
By using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

SECTION 1 - ACCESS AND ACCOUNT
You represent that you are at least the age of majority in your place of residence and you authorize any minor dependents using your devices to use the Services. You may be asked to provide contact, billing, payment and shipping details; you warrant this information is accurate and you have the right to provide it. You are responsible for safeguarding your account credentials and all activity under your account.

SECTION 2 - OUR PRODUCTS
We try to display products accurately, but colors/appearance may vary due to device settings and lighting. We do not warrant that any item will meet your expectations or exactly match images/renders. Descriptions may change without notice. We may discontinue products or limit quantities at our discretion.

SECTION 3 - ORDERS
Your order is an offer to buy. We may accept or decline any order at our discretion; payment must be processed before acceptance. If we change or cancel an order, we’ll try to notify you at the email/phone/billing address provided. Returns/exchanges are governed by our Return & Refund Policy. You confirm purchases are for personal/household use and not for resale or export.

SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions may change without notice. The price at checkout/confirmation applies and typically excludes taxes, shipping, handling, customs or import fees unless stated otherwise. You agree to provide current, complete billing information and authorize charges for the full amount including applicable taxes and shipping.

SECTION 5 - SHIPPING AND DELIVERY
Delivery times are estimates and not guaranteed. We are not liable for carrier delays, customs processing or events beyond our control. Title and risk of loss pass to you when we hand the order to the carrier.

SECTION 6 - INTELLECTUAL PROPERTY
All trademarks, content, designs, images, text, video, audio and their arrangement on the Services are owned by Metaloslav or its licensors and are protected by applicable IP laws. You may use the Services for personal, non-commercial purposes only and may not copy, distribute, modify, or create derivative works without our prior written consent. Metaloslav names/logos are our trademarks; Shopify’s marks are owned by Shopify.

SECTION 7 - OPTIONAL TOOLS
We may provide access to third-party tools “as is” and “as available” without warranties or liability. Use is at your own risk and subject to the providers’ terms. New features are also subject to these Terms.

SECTION 8 - THIRD-PARTY LINKS
Links to third-party sites or materials are provided for convenience. We are not responsible for their content, policies or practices. Access and transactions with third parties are at your own risk.

SECTION 9 - RELATIONSHIP WITH SHOPIFY
Metaloslav is powered by Shopify. However, purchases are made directly with Metaloslav. Shopify is not responsible for sales between you and Metaloslav, and you release Shopify from claims arising from such transactions.

SECTION 10 - PRIVACY POLICY
Personal data collected through the Services is handled per our Privacy Policy and Shopify’s privacy practices. Because our store is hosted by Shopify, information you submit may be processed by Shopify and certain partners (including outside your country) to operate and improve the Services.

SECTION 11 - FEEDBACK
If you submit reviews, ideas or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use and display it for any purpose. You warrant you have rights to the Feedback and that it complies with these Terms. We may remove Feedback we deem unlawful or objectionable.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
We may correct errors or update information (including pricing, availability, shipping) and cancel orders if any information is inaccurate, at any time without prior notice.

SECTION 13 - PROHIBITED USES
You may not use the Services for unlawful purposes; to violate laws; infringe IP; harass or harm; transmit misleading, malicious or infringing content; send spam; impersonate others; collect others’ data; or interfere with security or operation. We may suspend or terminate access for violations.

SECTION 14 - TERMINATION
We may terminate or suspend the Services at any time. Sections that by nature should survive termination will survive (including IP, Feedback, Disclaimers, Limitation of Liability, Indemnification, Governing Law).

SECTION 15 - DISCLAIMER OF WARRANTIES
Except as expressly stated by Metaloslav, the Services and products are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. Some jurisdictions do not allow certain disclaimers; in such cases, applicable law will apply.

SECTION 16 - LIMITATION OF LIABILITY
To the maximum extent permitted by law, Metaloslav and our officers, employees, agents, affiliates, contractors, licensors and service providers (and Shopify and its affiliates) will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits/revenue/data, arising from your use of the Services or products.

SECTION 17 - INDEMNIFICATION
You agree to indemnify and hold harmless Metaloslav, Shopify and their affiliates, officers, employees, agents and partners from claims arising out of your breach of these Terms, violation of law or rights of a third party, or your use of the Services.

SECTION 18 - SEVERABILITY
If any provision is unlawful or unenforceable, it shall be enforced to the maximum extent permitted and the remainder will continue in effect.

SECTION 19 - WAIVER; ENTIRE AGREEMENT
A failure to enforce a provision is not a waiver. These Terms and posted policies constitute the entire agreement and supersede prior communications. Ambiguities shall not be construed against the drafting party.

SECTION 20 - ASSIGNMENT
You may not assign your rights or obligations without our written consent. We may assign or transfer these Terms without notice.

SECTION 21 - GOVERNING LAW
These Terms and any disputes are governed by the laws of Ukraine, and you consent to the exclusive jurisdiction and venue of the courts located in Dnipro.

Headings are for convenience only and do not limit these Terms.

SECTION 23 - CHANGES TO TERMS OF SERVICE
We may update these Terms by posting a new version on this page and, where required by law, by providing notice. Continued use of the Services after changes constitutes acceptance.
